LIZ CHENEY'S LECTURE ON THE 'RULE OF LAW'.... Liz Cheney -- who appears on national television so often, her mail is now sent directly to network green-rooms -- was on Fox News again this morning. She seems to be expanding her repertoire a bit, moving beyond attacking Obama over torture, and now attacking Obama over the judiciary.

"[Y[ou know, you're not supposed to make decisions based on how you want the law to come out -- how you want the results to come out," Liz Cheney argued. "If you're a judge or a Justice, obviously one would hope that you would be just strictly interpreting the law, and I think we've heard in a number of instances President Obama talk about, sort of, a results-oriented approach to the law, or you know, making these determinations based on your heart or your empathy. And I think that's dangerous. I think that moves us away from the rule of law."

There's quite a bit of nonsense here, most notably the fact that President Obama has never "talked about" a "results-oriented approach to the law." Cheney just wants to smear, but she's a little too lazy to worry about details like facts and accuracy.

But the more hilarious aspect of this was hearing Liz Cheney lecture the Obama administration about the rule of law. This is, of course, the same Liz Cheney who has spent months insisting that no one from the Bush administration be held accountable, in any way, for systematic illegal abuse of detainees, authorized and endorsed by officials at the highest levels.

Last week, when the issue was torture, Cheney was unfazed by the prospecting of "moving us away from the rule of law." This week, the issue is apparently "empathy," and Cheney feels justified in lecturing the administration cleaning up her father's legal mess about the concept of impartial application of the law.

That she has no idea how ridiculous this sounds only adds insult to injury.

It's cute when five year olds can wheel between completely different justifications for whatever they're doing, but it's considerably less than charming when the apologists for war criminals do so.

Increasingly, I see mainstream journalism as an elaborate form of politeness. As in Japan, where one must sometimes pretend not to hear what one clearly just heard through, a modern American journalist must not embarrass a GOP politician by challenging their reality, no matter how self-serving or implausible.

Other than that, Liz Cheney lecturing anyone about the rule of law is a bit like Barry Bonds lecturing anyone about how to set aside one's ego.

Good to know the GOP -- despite being voted out of office, proving themselves incapable of basic governance, and offering up nothing in the way of actual solutions to our nation's problems -- still dominates and controls our national discourse.

Although the more they talk, the more ridiculous they sound, and the more people seem to hate them, so there is a bright side, I guess ...

This is a family effort: Dick doesn't want to go to jail. That's all it is. Dick and his family are doing everything they can to limit damage, and keep up their status in the Village. That's all it is.

And the painfully predictable and repetitive righteous outrage, and snark, and suggestions that the Republicans are not simply sleazy liars spouting corporate-scripted lies but are "crazy" or "confused" or "delusional" or "out of touch" or that they "don't know how ridiculous they sound" -- and the studiously oblivious head-scratching about why the corporate-owned media conglomerates broadcast and print such stuff -- all of that helps to fill out the blog space.

These conservatives do not understand what "interpretation" is. All judges (theoretically) interpret the law in order to effect justice.

What justice is in a particular case may be constrained by the law (including the standards of review and prejudice), but if the law itself determines its own interpretation (as the conservatives believe, or at least want to dupe others into believing), then judging could be done by algorithm. But like the rest of human activity, the law and its application cannot be broken down into binary code. Thus, when judges interpret the law, the important question often is how the judges at issue conceive what counts as justice.

I have little doubt that most Americans would prefer the conception of justice shared by Brennan, Marshall, and hopefully Sotomayor to the authoritarian/elitist conception of Roberts/Scalia/Thomas.

Unfortunately, the people in our American media appear too stupid, shallow, or partisan rightist to understand and explain this.

I said this yesterday, and I meant it...

I hereby vow, whenever I see the words "Liz Cheney", that I'll pass along my mother/daughter Cheney YouTube, where they are asked what the proper pronunciation of "Cheney" is, have completely different (ChAYney v. ChEEney) pronunciations, and have different, detailed stories about why it's pronounced that way. That's still "Weirdest Thing Of The Year" for me, and I wouldn't be surprised at all if the phrases "Skull And Bones" or "Opus Dei" are somewhere in the explanation.
