The federal government is supposed to issue new rules about debt levels for students in for-profit colleges. In the meantime, the states are working on their own regulations.
There arent nearly enough counterterrorism experts to instruct all of Americas police. So we got these guys instead.

TODD NOTICES 'LEGISLATING FROM THE BENCH'.... The standard conservative critique of judges and/or rulings they don't like is that they see evidence of "legislating from the bench." Most of the time the criticism doesn't apply, and doesn't even make sense, but it's more reflexive than anything else. (What do you call a judicial nominee you don't like? A "judicial activist.")
It was refreshing, then, to see NBC News' Chuck Todd note this morning that the five conservative members of the Supreme Court engaged in some legislating from the bench in yesterday's Ricci ruling.
Pay particular attention to Joe Scarborough's reaction. He not only acts as if the very idea is inexplicable, but suggests Todd is going into too much detail.

It is nice to see Chuck Todd tell the truth. The Supreme Court legislates. Sometimes it does it with a conservative bias. Sometimes (not in a long time) it does it with a liberal bias. It always does it to help corporations and the powerful hold the little guy down.

For a very long time, conservatives and liberals had a sado-masochistic relationship going. The conservatives beat on the liberals and the liberals took it.
The liberals have stopped taking it and conservatives are just confused.
"legislating from the bench" like "cheating on your wife" is supposed to be a liberal vice. When someone points out the unpleasant fact that conservatives do it too, they just don't know how to react.
I'm just surprised that Scarborough didn't respond with "Well Bill Clinton ....."

I'm shocked, shocked I tell you that a sycophant for Obama on the National Barack Consortium(NBC) would criticize a ruling of the Supreme Court that is actually found in the Constitution and begins to finally reverse the abomination that is affirmative action (discrimination).

PLEASE! This case was not black vs. white, GOP vs. Dems...it was states rights vs the feds. The issue was affirmative action. If you want to argue that the black firefighters that took the test got affirmative action to get there, then fine. But don't make things up. This case was not about white men getting screwed. In fact, you stand to lose a lot more if the Supremes precedent stands. Then all those pesky women and minorities will be coming after YOU.

BTW, Page 25 is where the new Title VII conflicts test is adopted in Kennedy's decision, just in case you want a talking point for that annoying guy at your lunch table.
