MAYBE SESSIONS SHOULD HAVE CHECKED WITH CEDARBAUM FIRST.... This week is Sen. Jeff Sessions' (R-Ala.) first chance to appear in the national spotlight in quite a long while. It doesn't seem to be going well.

Sen. Jeff Sessions (R., Ala.), seeking to discredit Judge Sonia Sotomayor's judicial philosophy, cited her 2001 "wise Latina" speech, and contrasted the view that ethnicity and sex influence judging with that of Judge Miriam Cedarbaum, who "believes that judges must transcend their personal sympathies and prejudices."

"So I would just say to you, I believe in Judge Cedarbaum's formulation," Sessions told Sotomayor.

"My friend Judge Cedarbaum is here," Sotomayor riposted, to Sessions's apparent surprise. "We are good friends, and I believe that we both approach judging in the same way, which is looking at the facts of each individual case and applying the law to those facts."

In fact, while Sessions held up Cedarbaum, a Reagan nominee, as having the superior approach to jurisprudence, Cedarbaum immediately backed Sotomayor. "I don't believe for a minute that there are any differences in our approach to judging, and her personal predilections have no affect on her approach to judging," she told the Wall Street Journal this morning.

Ian Millhiser extended some helpful advice to the conservative Alabama senator: "Note to Sessions: before you put words in a federal judge's mouth, make sure that she isn't in the hearing room to hear your false claim."

I don't understand why Repubs keep mentioning other people, like Estrada (Hispanic) and Cedarbeaum (woman). Is this normal? Are these supposed to be subtle jabs? Is it an attempt to appear non-racist/to support other Hispanics and women, just not this one (Soto)???

Ironically, Sessions has demonstrated repeatedly throughout his career that he doesn't actually believe that "judges must transcend their personal sympathies and prejudices." Such language coming from the right is part of their ongoing effort to deceive the American voter about what they really believe--that the law should be written and interpreted to favor the well-connected white male.

It wouldn't surprise me if Sessions *has* read her speech and knows full well what she really said. The man is shockingly dishonest.

It also wouldn't surprise me if Sessions has *not* read her speech and is just pulling wingnut talking points out of his ass. It is an open secret that many Senators are pretty dim.

Senator Gomer, er, Sessions made a complete fool of himself this morning. After Sotomayor had explained remarks she's made in speeches, multiple times and quite clearly I thought, Sessions continued to press her on them. Hello???

Meanwhile, Sen. Feinstein did a great job exposing the judicial activism by the 5 conservative justices in overturning Ricci while making the point that Sotomayor's decision was based on precedent. She was quite plain in countering the R's ridiculous claims about Sotomayor.

Pat Leahy is doing a great job as usual. Can't wait to hear Sen. Franken's questions. The Rs must be having a cow that he's on the judiciary committee! heehee

This was sort of a reverse Sean Hannity. Hannity will always put a liberal guest on the defensive by quoting someone else and ask them to agree or disagree...

However, Judge Sotomayor pulled a scene out of "Annie Hall" (ie waiting in the movie line and hearing someone quoting Marshal Mcluhan)

Mr. Sessions should know as a former prosecutor, never ask the witness a question that the prosecutor doesn't know the answer to.

There are a lot of things Sessions should know, as a former prosecutor (Ted, above), and as a people's elected official who, one hopes has a scintilla of sense and intelligence ... oh wait, he's an incumbent Republican, which Republicans seem to think means recumbent (and cosseted, indulged, entitled) Republican....

Ouch that's got to leave a mark. Reminds me of the immortal scene in Annie Hall when Woody Allen (as Alvey Singer) tells a blowhard "media" professor "well I happen to have Marshall McLuhan right here and lets hear what he has to say."

It ends with Woody looking at the camera and saying "wouldn't it be great if real life were like that."

I thought it would be and now I know. Who would have thought that Senator Sessions would ever make me ecstatic.

It was an impressive smackdown, especially considering that Sessions had just been reciting a litany of "this is what you think" crap, and explicitly putting words in her mouth -- no "this is my impression from what you've written" or "I'm concerned about this thing you said" but literally saying "this is what you wrote and this racist claptrap is what you meant by it." And after all that, he didn't even have the end with an actual question, just another statement.

I swear, if it had been me (and the obvious smackdown hadn't been hanging there), I would have been tempted to respond "Since you didn't ask a question and you seem intent on supplying my answer for me, I guess we're playing 'Jeopardy' -- could the question be 'A douchebag says what?'"
