'UNPRECEDENTED,' EXCEPT FOR ALL THE OTHER TIMES.... Joe Scarborough argued this morning that it's "unprecedented" for the U.S. to try foreign terror suspects in our federal judicial system. That might be true, if it weren't for all the other foreign terror suspects that have been tried, convinced, and imprisoned through our federal judicial system.
Bush administration used federal justice system to bring several foreign terrorism suspects to justice. During the George W. Bush administration, several foreign terrorists were brought to justice through the federal justice system, including 9-11 conspirator Zacarious Moussaoui, "Shoe bomber" Richard Reid and East African embassy bombing perpetrators Wahid el-Hage, Mohammed Sadiq Odeh, Mohammed Rashed al-Owhali, and Khalfan Khamis Mohammed.
Clinton administration also used federal justice system to bring foreign terror suspects to justice. During the Clinton administration, 1993 World Trade Center bomber Ramzi Ahmed Yousef and "urban terrorism" plotters Sheik Oma Abdel Rahman and others were brought to justice through the federal justice system.
There are already 216 international terrorists in U.S. prisons. A May 29 Slate.com article reported that according to data from the U.S. Bureau of Prisons, "federal facilities on American soil currently house 216 international terrorists and 139 domestic terrorists. Some of these miscreants have been locked up here since the early 1990s. None of them has escaped. At the most secure prisons, nobody has ever escaped."
Now, maybe Scarborough doesn't know anything about this subject. Maybe he forgot all the examples that prove how wrong he is. Maybe he just doesn't care.
But given the apoplexy, you'd think the KSM trial was something extraordinary. Indeed, it's no doubt what prompted Scarborough to assume it's "unprecedented." After all, with so many conservatives freaking out, it stands to reason the Obama administration is breaking all the rules. In reality, that's absurd -- the trial is actually routine.
It's also a reminder of how weak the right's complaining has been the last several days. If there's a strong case that terror trials are a bad idea, conservatives seem unable to make it.

It's all good that they're not getting much traction beyond the people who serve as their traction-mats. But I don't know how much good it does to fight this kind of nonsense with facts.
I think the "why are you such cowards" response is MUCH superior, because it meets an emotional attack with an emotional response (I can't really use the word "argument").
Yeah, it's basically schoolyard taunting, but the Villagers and the media love it, so it becomes the narrative. Unless we learn to compete on this turf as well as on facts, we're gonna keep fighting with one arm tied behind our backs.

These aren't just ordinary terrorists. THEY'RE ENEMY COMBATANTS IN THE WAR ON TERROR!!!
THIS IS WAR, Y'KNOW. Only the military can handle these guys on foreign soil cuz they're superhuman warriors with mind control powers and stuff like that. I mean, the minute they land in the U.S., they'll start making the civilian police kill themselves and then start raping the women. After they're done with that, they'll take over the nearest nuclear facility and cause a massive explosion.
I saw it on "24 Hours," which means it can happen.
If we're lucky, Jack Bauer will round 'em up, shoot them all and throw them in a ditch. Then we can feel safe (for now).

Another odd thing about this fuss is that the wingers keep bringing up the Allies' treatment of the Nazis as if this case supported their argument. They appear not to have heard of the Nuremberg trials.

You have to admit, Democrats are going on TV completely unprepared to debunk right wing fearmongering.
So here's some help:
(a) After letting Bin Laden escape in 2001, the Bush administration failed to bring any 9/11 conpirators to justice. Not one. At long last, Obama is bringing them to justice.
(b) Spain, Britain, Indonesia and India were all attacked over the last few years, they were brave enough to try their perps in their own courtrooms, not in kangaroo courts in other countries like Cuba.
(c) If we are too afraid to bring the attackers to justice through our own justice system, then they have won.

You may not think they are not making it but from my water cooler chats this morning they sure have!
St. Rudy of 9/11 still has a lot of pull where I work (a building from which we all watched in horror as the WTC burned).
My mom (middle 70s) was clucking about how Obama is making a big mistake. Several of my work neighbors are also clucking the same talking points. They are "tarrot-fied" that they will be released on a technicality.
Me? I think the only way to remove the stain of Gitmo/Rumsfeld/Buch is to have a day in court where ALL the dirty laundry gets aired. Let the chips fall where they may.

I heard a bit of On Point this morning, and the annoying right-wing guest repeatedly claimed that there was something terribly wrong with putting non-citizens on trial in a U.S. civilian court. Neither the host nor the other, pro-trial guest seemed to push back at all. (I can't speak to what happened after I got sick of the whole thing and turned it off.) Very disappointing.
